Right of Withdrawal for Consumers

Consumers who conclude contracts with us have, in principle, a statutory right of withdrawal according to § 355 BGB (German Civil Code). The withdrawal period is 14 days and begins on the purchase date.

Withdrawal from Digital Products – Exclusion Upon Use

IMPORTANT: According to § 356d BGB, the right of withdrawal expires for digital products if you have expressly consented to prior use and understood that this causes you to lose your right of withdrawal.

Bricks2Etch is a digital product (plugin software). Once you:

  • Download the plugin
  • Install the plugin
  • Use the plugin for migration
  • Have your data processed by the plugin

…the right of withdrawal becomes invalid because you have made use of the digital product.

Refund Policy for Bricks2Etch

Reason for the Exclusion of Refunds

Since Bricks2Etch is a specialized tool for migrating from Bricks Builder to Etch:

  1. Immediate Usability: The plugin is fully functional and ready to use immediately after purchase
  2. Uncontrollable Use: After installation, users can use the plugin indefinitely and then file refund requests without restriction
  3. Uncontrollable Distribution: A digital file can be duplicated after download
  4. Specific Use: The plugin is purchased specifically for a one-time migration and cannot be “returned”

No Refunds

We do not offer refunds for Bricks2Etch. Every purchase is final.

This applies in particular to:

  • ✗ Buyers who purchase the plugin, use it for migration, and then request a refund
  • ✗ Buyers who use the plugin and later discover they don’t need it
  • ✗ Buyers who purchase the plugin, download it, and challenge the payment
  • ✗ Technical problems caused by unsupported environments

Exceptions (Store Credit Instead of Refund)

The only exceptions are:

1. Actual Technical Errors in the plugin that make operation impossible – Proof through support required – Store credit instead of refund – No cash reimbursement

2. Duplicate Payment (technical error) – Automatic refund of the duplicate amount – Customer must notify immediately

3. Unauthorized Transaction (fraud) – Full refund of the amount

Your Rights in Case of Defects

If Bricks2Etch is defective (does not function as described), you have the right according to our General Terms and Conditions to:

  • Subsequent Performance (we fix the error)
  • Price Reduction (partial refund)
  • Cancellation of the contract (if the error cannot be remedied)

This is independent of the refund policy and is your statutory right!

Right of Withdrawal Application (consumers only, before use)

If you have not used the plugin and wish to exercise your right of withdrawal within 14 days, you must:

  1. Declare your withdrawal in writing (email is sufficient)
  2. Clearly state that you wish to exercise your right of withdrawal
  3. Provide your order number
  4. Confirm that you have not used the plugin

Withdrawal Confirmation: The Provider will promptly confirm the withdrawal in writing.
